General terms and conditions of Lupenbrillen24.ch

1. validity of the GTC and conclusion of the contract

1.1 The following General Terms and Conditions apply to all deliveries between us and you as a customer in the version valid at the time of the order.

The following regulations on the conclusion of the contract apply to orders placed via the webshop of www.lupenbrillen24.ch (hereinafter referred to as "Webshop") as well as to all other ordering options provided by us currently or in the future (namely orders placed via e-mail or messenger services such as WhatsApp). In the event of the conclusion of a contract, the contract is concluded with:

1.2 The presentation of the goods in our web shop does not constitute a legally binding offer of contract on our part, but is only a non-binding invitation to you as a customer to order goods and constitutes a non-binding online catalogue. The offer to conclude a sales contract is made by you as a customer by clicking on the button "place order" (order) after completely filling out the order page. You shall remain bound to your order for seven (7) days. After you have placed your order, you will receive an automated confirmation e-mail (order confirmation) regarding the receipt of your order by us, which, however, does not constitute an acceptance of the contract. The purchase contract is considered concluded when you receive an order confirmation from us by email or at the latest when the goods are delivered. If, in exceptional cases, the order is not executed until after the above-mentioned seven-day period, the delivery of the goods is a new offer to conclude a purchase contract. You can accept this offer tacitly by accepting and using the goods or explicitly. In this respect we waive the receipt of the declaration of acceptance.

1.3 If it becomes known after conclusion of the contract that the goods are not available from the supplier in the foreseeable future, we reserve the right to withdraw from the contract. In this case, we will inform you immediately after we become aware of the non-availability of the goods and refund any consideration already received without delay.

1.4 If a purchase contract is concluded, we at Lupenbrillen24 do not save the text of the contract. However, we will send you your order data by email and store them in our customer area. You can view past orders there after logging in under "My account -> Order history".


2. offer description

2.1 Magnifying glasses24 endeavours to name product descriptions as precisely as possible. For this purpose, original information from the manufacturer and supplier is used, but without guarantee of its accuracy. Changes on the part of the manufacturer can occur without prior notice.

2.2 Deviations from illustrations of individual products cannot be excluded. Lupenbrillen24 makes every effort to keep the illustrations up to date.

2.3 Colours and samples of the delivered loupes may differ from the illustrations on the Internet. Colours of loupe frames may also differ from the illustrations on the Internet.

2.4 Magnifying glasses24 does not determine and does not check the individual defective vision of the customers. To order magnifying glasses or LED's it is necessary to specify the magnification, working distance (eyepiece focal length) and, if necessary, frame size, etc. The customer himself is responsible for the correct information. Lupenbrillen24 accepts no liability for incorrect information.


3. prices and payment

3.1 The prices are quoted in Swiss Francs (CHF) and include the legal value added tax.

3.2 The customer has the option of paying by Visa, Mastercard, Maestro, AMEX, PayPal, Twint, Apple Pay, Google Pay, Union Pay, Shop Pay, Union Pay, PostFinance or prepayment.

3.3 Magnifying glasses24 reserves the right to change the prices at any time. For customers, the prices published in the web shop on the order date apply. If the prices in the web shop are increased or reduced before the goods are delivered, the price at the time of the order shall apply, even if the contract has not yet been confirmed.

3.4 Vouchers as well as special discounts are not cumulative and can only be redeemed once per household.

3.5 If the amount to be paid by the customer cannot be finally credited or is redebited for other reasons due to a lack of sufficient credit card or account cover, Lupenbrillen24 shall be entitled to charge the customer a lump-sum compensation of CHF 80 for redebiting costs. This lump-sum compensation may be increased if a higher loss has been incurred in an individual case.

3.6 Lupenbrillen24 shall retain title to the delivered goods in any case until the respective invoice amount of a delivery has been paid in full (final and unconditional crediting of the total purchase price including any additional costs). Lupenbrillen24 shall not be obliged to deliver until payment has been made in full. If full payment is not made within a maximum of 30 days of order confirmation, Lupenbrillen24 shall reserve the right to withdraw from the contract.

3.7 The customer shall bear all costs incurred by Lupenbrillen24 as a result of the delay in payment. In particular, the customer shall owe Lupenbrillen24 default interest of 5% p.a. and a flat-rate reminder fee of CHF 15 per reminder. Lupenbrillen24 may at any time call in third parties for collection. For this purpose the customer shall pay the third party directly minimum fees and, in addition, compensate him for his individual expenses and outlays necessary for the collection.


4. delivery

4.1 Magnifying glasses24 is very keen to keep delivery times as short as possible. However, delivery times stated in the order confirmation are not binding.

4.2 Magnifying glasses24 is entitled to make partial deliveries. In this case the customer will be charged only once for the shipping costs.

4.3 If the customer's address changes, he shall be obliged to notify Lupenbrillen24 of this without delay. If the customer fails to notify Lupenbrrillen24, the last known address shall be the delivery address. The costs of determining the address and any additional delivery costs shall be borne by the customer.

4.4 The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the customer until the goods are handed over to the customer.

4.5 Transport damages caused by delivery are insured by Lupenbrillen24. The insurance claim can only be asserted if the customer has the damage confirmed by the supplier upon delivery of the product.


5. right of return

5.1 We grant you a 30-day right of return on the products purchased from us (exceptions reserved) under the following conditions and refund the purchase price (deductions reserved for certain products).

5.2 To be able to exercise this right for contact lenses and contact lens care products, the packaging must be undamaged and in unopened condition. Annual lenses and toric contact lenses are excluded from this right of return.

5.3 We also grant you a 30-day right of return for corrective eyewear, even though it was made entirely according to your needs as a unique piece. Under this money-back guarantee, we will refund the purchase price. For correction glasses, we deduct a service fee from the purchase price to be refunded: for correction clip or single vision glasses in the amount of CHF 50.- for multi-focal glasses of CHF 150.-.

5.4 In order to make use of the right of return, please return the goods to us in mint condition within 30 days of the date of dispatch in the original packaging. We ask you to use the enclosed invoice/delivery note as a return note. The 30-day right of return begins with the dispatch of the goods and the return ends with the timely dispatch. The time of dispatch of the goods is decisive for compliance with the return period. The costs for the return shipment are to be borne by you. The return shipment is to be addressed to:

5.5 We will accept the return of goods if the goods are in their original condition and the original invoice is enclosed. We reserve the right to deduct the corresponding costs from the purchase price to be refunded as compensation for possible damage or excessive wear and tear.

5.6 If the return of magnifying spectacles24 has been accepted, payments already made will be refunded free of charge within 30 days of receipt of the goods, less the service fee mentioned in Clause 5.3 for corrective spectacles and the deductions mentioned in Clause 5.5 for possible damage or excessive wear. Discount vouchers are not refundable within the scope of this right of return. The purchase price will be refunded using the method of payment you selected when placing your order.


6. no warranty

Any warranty obligation on the part of Lupenbrillen24 is hereby waived and the assertion of warranty rights by the customer is thus excluded.


7. liability

7.1 Subject to mandatory statutory provisions to the contrary, Lupenbrillen24 shall only be liable in cases of intent and gross negligence. If Lupenbrillen24 is legally liable for slight negligence, it shall only be liable insofar as the damage was reasonably foreseeable at the time of conclusion of the contract.

7.2 Clause 6 para. 1 shall also apply to vicarious agents, representatives or executives of Lupenbrille24.

7.3 Magnifying glasses24 is not liable for damage caused by improper use.

7.4 Magnifying glasses24 is not liable for the content of external links. The content and updating of linked websites and/or websites of affiliate partners are the sole responsibility of their operators.

7.5 All cases of breach of contract and their legal consequences as well as all claims of the customer, regardless of the legal basis, are conclusively regulated in these GTC. Under no circumstances shall the customer be entitled to claim compensation for damages that have not occurred to the goods themselves. A liability claim that exceeds the value of the order is excluded. This exclusion of liability does not apply to unlawful intent (intention) or gross negligence.


8. security and privacy

8.1 Data protection is a central concern of Lupenbrillen24 and we comply with the applicable legal requirements when processing personal data. We store the data of our customers and pass this data on to partners (e.g. opticians) or to other parties, as far as this is necessary in the run-up to the conclusion of a contract or for the processing of a contract. Furthermore, we assure you that we will not pass on your address data to other third parties.

8.2 Registered users: If you register as a user, Lupenbrillen24 reserves the right to serve you with a Lupenbrillen24 newsletter. You can unsubscribe from this newsletter service at any time.

8.3 Securing customer information: If you place an order with us and thus make your account information accessible, we use a security certificate (data encryption) for your protection. The security certificate (SSL) encrypts all information you enter before it is sent to us. In addition, all customer data is protected against unauthorised access by state-of-the-art measures. We would like to point out, however, that we cannot guarantee 100% data security for transmissions over the Internet.

11. severability clause

If any provision of these Terms and Conditions is unenforceable or invalid, it shall be ineffective only to the extent that it is unenforceable or invalid, and shall be replaced by a valid and enforceable provision which the parties believe in good faith to be commercially closest to the invalid or unenforceable provision. The remaining provisions of the contract shall in any case remain in full force and effect.


12. reservation of right of modification

12.1 Magnifying glasses24 can change these terms and conditions at any time. The customer will be notified of the changes by e-mail or other suitable means online. As soon as the customer makes use of the services of Lupenbrillen24 after the change, he shall implicitly agree to the new GTC. 12.2 Other contractual conditions of the customer, in particular also those which the customer declares to be applicable together with the acceptance of the contract, do not become part of the contract. They shall only be valid if and insofar as they have been expressly accepted by Lupenbrillen24 in writing.


13. application of law and place of jurisdiction

13.1 These General Terms and Conditions shall be governed by substantive Swiss law to the exclusion of the conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2 Exclusive place of jurisdiction is Zurich. Alternatively, Lupenbrillen24 shall be entitled to sue customers at their domicile.
